Purpose and legal basis of the processing of personal data
The purpose of processing is to fulfil the public duties assigned to us by law.
Unless otherwise stated, the legal basis for the processing of your data is Section 4(1) of the Bavarian Data Protection Act (Bayerisches Datenschutzgesetz) in conjunction with Article 6(1)(c) of the EU General Data Protection Regulation (GDPR). This legal basis permits us to process the data required to fulfil a duty assigned to us.
If you have given your consent to processing, this data processing is also based on Art. 6(1)(A) GDPR.

The technical operation of our data processing systems for electronic processing of your data is provided by the Bavarian Agency for Digitisation, High-Speed Internet and Surveying (LDBV).

We will only store your data for as long as necessary to fulfil our obligations with due regard to statutory retention periods.

If we process your personal data, you have the following rights as a data subject:
• If your personal data is processed, you have the right of access to information regarding the data stored about you (Art. 15 GDPR).
• If the personal data being processed is inaccurate, you have the right to rectification of this data (Art. 16 GDPR).
• If the statutory requirements are met, you may demand the erasure of this data or the restriction of processing or object to the processing (Arts. 17, 18 and 21 GDPR).
• If you have consented to the processing or a data processing agreement exists and the data processing is carried out by automated means, you also have a right to data portability (Art. 20 GDPR).
• If you have consented to data processing and the processing takes place on the basis of this consent, you can revoke your consent at any time with effect for the future. However, such revocation does not affect the lawfulness of any prior data processing based on your consent.

Protocols
When you access this and other websites, data will be transferred to our server via your browser. The following data is recorded while a connection exists between your browser and our server:
• Date and time of request
• Name of requested file
• Page from which the file request originated
• Access status (file transmitted, file not found, etc.)
• Browser and operating system used
• Full IP address of the computer sending the request
• Volume of data transmitted
We store this data for technical security reasons, in particular to defend against attacks on our server. This data will be anonymised after no more than seven days through truncation of the IP address at the domain level, which makes it impossible to attribute the data to individual users. This data is processed exclusively for this purpose and in anonymised form for statistical purposes. Your data will not be compared with other databases or transmitted to third parties, either in whole or in part.
Active components
The information provided by the publishing authority uses active components such as JavaScript, Java applets and ActiveX controls. You can deactivate these components by configuring your browser settings.
Cookies
When you access this website, we will store cookies (small files) on your hard drive, which remain in place for up to two years. We use these cookies exclusively to identify you during this and future visits to our website. Most browsers are configured in such a way that they accept the use of cookies. However, you can deactivate this, either for your current session or permanently, by configuring your browser settings.

Analysis of user behaviour (web tracking systems)
We only use programs to analyse user behaviour by anonymous means. In this context, your IP address is anonymised before we use this data or transmit it to third parties for analysis. You can deactivate these components by configuring your browser settings.
Integration of YouTube videos
Videos from YouTube, an external video platform, are integrated on our website. By default, we only integrate deactivated images from the YouTube channel, which does not establish an automated connection with YouTube’s servers. Consequently, the operator does not receive any data from the user when accessing the website.
You can decide for yourself whether to activate YouTube videos. You only give consent to the necessary data (including the current webpage address and the user’s IP address) being transmitted to the operator when you allow the videos to be played by clicking on “Always allow”.
We place a cookie that stores this parameter to store a user’s desired configuration. However, we do not store any personal data by placing such cookies, as they only contain anonymised data regarding browser customisation. The videos are then active and can be played by the user. If you then wish to deactivate the automatic loading of YouTube videos, you can revoke your consent by removing the tick in the relevant box under the data privacy symbol. This will also update your cookie settings.
Mobile use
If you access the State Ministry’s homepage using a mobile device, we will use programs to analyse your user behaviour in exclusively anonymised form. Your IP address is anonymised before it can be used for analysis.
Collection of further data
If you enter personal or business information in our website (e.g. email addresses, names, addresses, etc.), we will use this information exclusively for the purpose of providing the desired information or for the purposes specified in the respective form. Your data will be encrypted during transmission using SSL software and protected against third-party access. Your data will not be disclosed to third parties. The use of these services on our website is voluntary.
We store email addresses provided for newsletter distribution and use them exclusively to distribute newsletters. You can unsubscribe from a newsletter at any time by following the instructions at http://www.stmwk.bayern.de/newsletter.html. Your email address will then be automatically deleted.
If you provide your address to order publications, we will use your address exclusively for this purpose. We will then delete your data no more than one year after we receive your order.
Email
Information sent to us in unencrypted form via email may be accessed by third parties during transmission. We are not usually able to verify the identity of email senders and do not know who is behind an email address. Standard email is therefore not a legally secure form of communication. Like many email providers, we use filters to combat unsolicited advertisements (spam). In rare cases, these filters can also automatically mistake normal emails for spam and delete them. In any case, we automatically delete any emails containing malware, such as viruses.
If you wish to send us a message that should be considered confidential, we recommend either encrypting and signing your message to prevent unauthorised access and manipulation, or sending the message by post. Please send PGP-encrypted emails to us using the following email address: poststelle@stmwk.bayern.de. You can access the necessary PGP public encryption key from the central PGP key server operated by the Bavarian Government Network (Bayerisches Behördennetz) at: pgp-keyserver.bayern.de. You can find information about GpG4Win, a free-to-download encryption software developed on behalf of the Federal Office for Data Security (BSI), at: http://www.gpg4win.de/. The G4G4Win website also includes a brochure (in PDF format) that provides further details on establishing PGP to communicate with the Bavarian administrative authorities.
In your message, please also state whether and how we can respond to your encrypted emails and, if we are unable to use an encrypted method, whether you consent to us to your message replying via unencrypted email. If you are unable to receive encrypted emails, we ask that you specify a postal address so that we can respond to confidential messages.

We take photographs at events and engagements as part of our press and public relations activities. You may be identifiable in these photographs. You can object to these photographs being taken and to their publication.
